1.我(wo)國農產品(pin)出口遭遇的反傾銷(xiao)訴訟增(zeng)多
近年來(lai),我(wo)國(guo)農(nong)產(chan)品出口(kou)(kou)遭遇(yu)的(de)(de)反傾(qing)銷訴訟越來(lai)越多(duo),已成(cheng)為(wei)阻礙我(wo)國(guo)農(nong)產(chan)品出口(kou)(kou)的(de)(de)主要非關稅壁(bi)壘(lei)之一。截(jie)止(zhi)目前(qian),我(wo)國(guo)所遭遇(yu)的(de)(de)各種反傾(qing)銷已經達到了500多(duo)起,我(wo)國(guo)已連續7年成(cheng)為(wei)世界頭號反傾(qing)銷目標國(guo)。針對我(wo)國(guo)的(de)(de)反傾(qing)銷案(an)件給我(wo)國(guo)出口(kou)(kou)造(zao)成(cheng)了巨大的(de)(de)損失,我(wo)國(guo)農(nong)產(chan)品的(de)(de)國(guo)際(ji)市場(chang)份額嚴重萎(wei)縮,有些甚(shen)至已經被迫退出市場(chang),構成(cheng)了對我(wo)國(guo)農(nong)產(chan)品出口(kou)(kou)的(de)(de)巨大障礙。

二、中日農(nong)產品貿易(yi)開發與農(nong)業(ye)資源配置效益
眾所周知(zhi),傳統的農產(chan)品貿易(yi)形式(shi)是(shi)(shi)出(chu)口(kou)國(guo)將農產(chan)品出(chu)售(shou)給進口(kou)國(guo),貿易(yi)雙(shuang)方(fang)是(shi)(shi)單純的商品交換關系(xi),并不涉及(ji)生(sheng)產(chan)領域里的合作。而(er)20世紀90年代后期開(kai)始的日(ri)本從中(zhong)國(guo)的農產(chan)品(主要是(shi)(shi)蔬菜)開(kai)發進口(kou),則是(shi)(shi)雙(shuang)方(fang)為了(le)(le)貿易(yi)展(zhan)開(kai)了(le)(le)生(sheng)產(chan)領域里的合作,形成(cheng)了(le)(le)貿易(yi)與開(kai)發生(sheng)產(chan)一(yi)體化的貿易(yi)新形式(shi)。這種貿易(yi)形式(shi)主要有3個基本特征:日(ri)方(fang)商社以訂單形式(shi)向中(zhong)方(fang)企(qi)業訂購產(chan)品,日(ri)方(fang)提供生(sheng)產(chan)訂購產(chan)品的生(sheng)產(chan)資料及(ji)生(sheng)產(chan)技(ji)術(shu);整(zheng)個生(sheng)產(chan)過程按照日(ri)方(fang)的技(ji)術(shu)指導進行,產(chan)品質量標準(zhun)必(bi)須完全(quan)符合日(ri)方(fang)要求(qiu);所生(sheng)產(chan)的合格產(chan)品全(quan)部由(you)日(ri)方(fang)商社進口(kou)到日(ri)本。
日本(ben)在(zai)中國(guo)(guo)開發進口(kou)的農產(chan)品主(zhu)要(yao)有:肉食加(jia)工(gong)(gong)品、面(mian)食加(jia)工(gong)(gong)品、蔬(shu)(shu)菜(包括蔬(shu)(shu)菜加(jia)工(gong)(gong)品)等。其中,蔬(shu)(shu)菜的開發進口(kou)量約(yue)占從中國(guo)(guo)進口(kou)蔬(shu)(shu)菜總量的70%。在(zai)蔬(shu)(shu)菜的開發進口(kou)中,日本(ben)大蔥(cong)(cong)是(shi)鮮為人知的產(chan)品,2001年日本(ben)從中國(guo)(guo)進口(kou)的3.7萬噸大蔥(cong)(cong)中有90%以上(shang)屬(shu)于在(zai)中國(guo)(guo)開發生產(chan)的日本(ben)大蔥(cong)(cong)品種。

由表(biao)1可以看出(chu)(chu)(chu),2008年(nian)(nian)(nian)國(guo)(guo)際金融危機(ji)前后(hou),中(zhong)國(guo)(guo)的創(chuang)(chuang)意(yi)產(chan)(chan)品出(chu)(chu)(chu)口額(e)均超過(guo)美(mei)(mei)國(guo)(guo)創(chuang)(chuang)意(yi)產(chan)(chan)品出(chu)(chu)(chu)口額(e),特(te)別在(zai)2008年(nian)(nian)(nian)和2011年(nian)(nian)(nian)金融危機(ji)前后(hou)差距最(zui)大。2008年(nian)(nian)(nian)和2011年(nian)(nian)(nian)中(zhong)國(guo)(guo)的創(chuang)(chuang)意(yi)產(chan)(chan)品出(chu)(chu)(chu)口額(e)分別為848.07億美(mei)(mei)元(yuan)和1256.46億美(mei)(mei)元(yuan),分別超過(guo)美(mei)(mei)國(guo)(guo)350.0億美(mei)(mei)元(yuan)和343.76億美(mei)(mei)元(yuan)。并且通過(guo)圖(tu)1可以看出(chu)(chu)(chu),美(mei)(mei)國(guo)(guo)創(chuang)(chuang)意(yi)產(chan)(chan)品出(chu)(chu)(chu)口受到金融危機(ji)的沖(chong)擊要大于(yu)中(zhong)國(guo)(guo)所受到的沖(chong)擊,因(yin)為在(zai)金融危機(ji)后(hou),中(zhong)國(guo)(guo)的創(chuang)(chuang)意(yi)產(chan)(chan)品出(chu)(chu)(chu)口雖(sui)然遭(zao)遇了(le)一段時間的衰退卻迅(xun)速在(zai)2011年(nian)(nian)(nian)達(da)到了(le)歷史(shi)最(zui)大值,而美(mei)(mei)國(guo)(guo)的創(chuang)(chuang)意(yi)產(chan)(chan)品出(chu)(chu)(chu)口雖(sui)然也在(zai)持續回升,但恢復(fu)幅度遠小于(yu)中(zhong)國(guo)(guo),并且2011年(nian)(nian)(nian)的出(chu)(chu)(chu)口額(e)低于(yu)2008年(nian)(nian)(nian)。

2.1文(wen)化(hua)(hua)(hua)(hua)貿(mao)易(yi)結構凌亂改革開放(fang)三十(shi)年特別是進入21世(shi)紀后(hou),我(wo)國對外(wai)貿(mao)易(yi)事(shi)(shi)業(ye)(ye)(ye)發(fa)展(zhan)迅猛(meng),取得舉世(shi)矚目(mu)的(de)(de)成(cheng)就。據(ju)海(hai)關統計,2012年我(wo)國外(wai)貿(mao)進出口(kou)總值38667.6億(yi)美元(yuan)(yuan),比上(shang)年增長6.2%。其中(zhong)出口(kou)20498.3億(yi)美元(yuan)(yuan),增長7.9%;進口(kou)18178.3億(yi)美元(yuan)(yuan),增長4.3%;貿(mao)易(yi)順差(cha)2311億(yi)美元(yuan)(yuan),擴大48.1%。2.2知識(shi)產(chan)(chan)權保(bao)護不周縱觀文(wen)化(hua)(hua)(hua)(hua)產(chan)(chan)業(ye)(ye)(ye)的(de)(de)各行各業(ye)(ye)(ye),所生產(chan)(chan)的(de)(de)文(wen)化(hua)(hua)(hua)(hua)產(chan)(chan)品都屬于知識(shi)結晶,都在(zai)(zai)知識(shi)產(chan)(chan)權的(de)(de)保(bao)護范疇之內。目(mu)前(qian),社(she)會上(shang)多數行業(ye)(ye)(ye)存在(zai)(zai)以(yi)次仿正(zheng)謀取暴(bao)利(li)(li),其中(zhong)以(yi)文(wen)化(hua)(hua)(hua)(hua)行業(ye)(ye)(ye)最盛(sheng)。以(yi)影視(shi)產(chan)(chan)業(ye)(ye)(ye)為例,一(yi)張(zhang)空白的(de)(de)光盤售價不過(guo)幾(ji)元(yuan)(yuan)錢,但(dan)一(yi)旦記錄(lu)影片(pian)視(shi)頻后(hou)便(bian)可達數十(shi)元(yuan)(yuan),所增加的(de)(de)價值便(bian)是智(zhi)力(li)勞動(dong)成(cheng)果所具有的(de)(de)價值,但(dan)一(yi)張(zhang)盜版碟往往比正(zheng)版便(bian)宜的(de)(de)多,對普通消費者(zhe)(zhe)來說,其質(zhi)量相差(cha)無幾(ji),故而價格驅使他們(men)購買盜版,這便(bian)使得創(chuang)作(zuo)者(zhe)(zhe)利(li)(li)益(yi)受到(dao)(dao)侵害。長此以(yi)往,便(bian)會打擊創(chuang)作(zuo)者(zhe)(zhe)的(de)(de)創(chuang)作(zuo)熱情,使得文(wen)化(hua)(hua)(hua)(hua)事(shi)(shi)業(ye)(ye)(ye)的(de)(de)繁(fan)榮被(bei)徹(che)底打破。中(zhong)國大部分(fen)地(di)區關于知識(shi)產(chan)(chan)權保(bao)護的(de)(de)法(fa)律基(ji)礎不夠完(wan)善,執法(fa)力(li)度較弱,同時司(si)法(fa)訴訟階段原(yuan)告舉證的(de)(de)責(ze)任太重(zhong),人們(men)認識(shi)也不夠到(dao)(dao)位。因此,在(zai)(zai)文(wen)化(hua)(hua)(hua)(hua)事(shi)(shi)業(ye)(ye)(ye)的(de)(de)發(fa)展(zhan)過(guo)程中(zhong)保(bao)護創(chuang)造人群的(de)(de)利(li)(li)益(yi)是至關重(zhong)要的(de)(de)。
二、推(tui)動中國對(dui)外(wai)文化貿易(yi)發展(zhan)的對(dui)策措施

由于(yu)(yu)農(nong)(nong)業(ye)的(de)(de)(de)(de)特(te)殊性,長期以來農(nong)(nong)產(chan)品貿(mao)易(yi)(yi)一(yi)直游離于(yu)(yu)世(shi)界貿(mao)易(yi)(yi)組織的(de)(de)(de)(de)規則以外。自烏拉圭(gui)回(hui)合(he)啟動以來,農(nong)(nong)產(chan)品貿(mao)易(yi)(yi)才被納入談(tan)(tan)(tan)判(pan)(pan)(pan)的(de)(de)(de)(de)議程(cheng)之中(zhong)(zhong)(zhong)。農(nong)(nong)業(ye)貿(mao)易(yi)(yi)談(tan)(tan)(tan)判(pan)(pan)(pan)在(zai)“多哈回(hui)合(he)”談(tan)(tan)(tan)判(pan)(pan)(pan)中(zhong)(zhong)(zhong)最(zui)為(wei)(wei)引人注目。根(gen)據多哈宣言,新一(yi)輪農(nong)(nong)業(ye)談(tan)(tan)(tan)判(pan)(pan)(pan)的(de)(de)(de)(de)目標是(shi)要大(da)幅度削(xue)減(jian)乃至消除各種形(xing)式的(de)(de)(de)(de)出口補貼(tie)(tie),大(da)幅度擴大(da)農(nong)(nong)產(chan)品市場(chang)準入,以建立(li)一(yi)個市場(chang)導向(xiang)的(de)(de)(de)(de)、公平的(de)(de)(de)(de)世(shi)界貿(mao)易(yi)(yi)體系。然而(er),無論對發達成(cheng)(cheng)員(yuan)還是(shi)對發展中(zhong)(zhong)(zhong)成(cheng)(cheng)員(yuan),農(nong)(nong)業(ye)問題都是(shi)特(te)殊而(er)敏感的(de)(de)(de)(de)。尤其(qi)在(zai)大(da)多數發展中(zhong)(zhong)(zhong)國(guo)家,農(nong)(nong)業(ye)占(zhan)國(guo)民經濟的(de)(de)(de)(de)比重雖大(da),但農(nong)(nong)業(ye)勞動生產(chan)率低,這使它們在(zai)國(guo)際市場(chang)競爭中(zhong)(zhong)(zhong)處于(yu)(yu)不利地位;而(er)以歐盟(meng)和(he)美國(guo)為(wei)(wei)代表(biao)的(de)(de)(de)(de)發達成(cheng)(cheng)員(yuan)不僅(jin)擁有先進(jin)的(de)(de)(de)(de)農(nong)(nong)業(ye)技術,還為(wei)(wei)本國(guo)農(nong)(nong)民提供(gong)大(da)量補貼(tie)(tie),因(yin)此,在(zai)國(guo)際市場(chang)競爭中(zhong)(zhong)(zhong)占(zhan)有優勢。
一、我國農產品面臨的貿(mao)易環境
(一)高(gao)(gao)(gao)關稅(shui)(shui)(shui)(shui)(shui)(shui)仍是當(dang)前(qian)世界(jie)農(nong)(nong)產品(pin)(pin)的(de)(de)(de)(de)(de)主要保護手段(duan)。烏拉圭回合(he)將農(nong)(nong)產品(pin)(pin)全面納(na)入自由化談判之(zhi)列,大幅度削減農(nong)(nong)產品(pin)(pin)關稅(shui)(shui)(shui)(shui)(shui)(shui)也是多(duo)方關注的(de)(de)(de)(de)(de)議題。但據(ju)WTO綜合(he)數據(ju)庫顯示,2001年所有成員的(de)(de)(de)(de)(de)農(nong)(nong)產品(pin)(pin)配額內平(ping)均關稅(shui)(shui)(shui)(shui)(shui)(shui)達62%,配額外關稅(shui)(shui)(shui)(shui)(shui)(shui)達123%。而且,仍存在大量非從價關稅(shui)(shui)(shui)(shui)(shui)(shui)、關稅(shui)(shui)(shui)(shui)(shui)(shui)高(gao)(gao)(gao)峰、關稅(shui)(shui)(shui)(shui)(shui)(shui)升(sheng)級(ji)現(xian)象。如,美國的(de)(de)(de)(de)(de)非從價關稅(shui)(shui)(shui)(shui)(shui)(shui)占(zhan)(zhan)43.8%,歐盟(meng)的(de)(de)(de)(de)(de)占(zhan)(zhan)43.6%,日(ri)本的(de)(de)(de)(de)(de)占(zhan)(zhan)15%,加(jia)拿大占(zhan)(zhan)28%。大量非從價關稅(shui)(shui)(shui)(shui)(shui)(shui)的(de)(de)(de)(de)(de)存在隱藏了實(shi)際保護水平(ping),未(wei)能實(shi)現(xian)wro關稅(shui)(shui)(shui)(shui)(shui)(shui)透(tou)明(ming)化目的(de)(de)(de)(de)(de)。根據(ju)Gernat、Lairt和(he)Turrini2002年研(yan)究顯示,關稅(shui)(shui)(shui)(shui)(shui)(shui)高(gao)(gao)(gao)峰農(nong)(nong)產品(pin)(pin)中(zhong),關稅(shui)(shui)(shui)(shui)(shui)(shui)超過(guo)30%的(de)(de)(de)(de)(de)農(nong)(nong)產品(pin)(pin),美國有20%,歐盟(meng)有25%,日(ri)本則達30%。歐盟(meng)的(de)(de)(de)(de)(de)加(jia)工(gong)食(shi)品(pin)(pin)(不包(bao)括(kuo)初(chu)加(jia)工(gong)階段(duan))占(zhan)(zhan)所有關稅(shui)(shui)(shui)(shui)(shui)(shui)高(gao)(gao)(gao)峰的(de)(de)(de)(de)(de)30%,稅(shui)(shui)(shui)(shui)(shui)(shui)率從12%到(dao)100%不等(deng)。美國實(shi)行關稅(shui)(shui)(shui)(shui)(shui)(shui)高(gao)(gao)(gao)峰的(de)(de)(de)(de)(de)產品(pin)(pin)包(bao)括(kuo)橘子汁(zhi)(31%)、花生油(132%)以及(ji)某些煙草產品(pin)(pin)(350%)。日(ri)本的(de)(de)(de)(de)(de)加(jia)工(gong)食(shi)品(pin)(pin)占(zhan)(zhan)關稅(shui)(shui)(shui)(shui)(shui)(shui)高(gao)(gao)(gao)峰產品(pin)(pin)的(de)(de)(de)(de)(de)40%,包(bao)括(kuo)罐裝的(de)(de)(de)(de)(de)肉和(he)肉制(zhi)品(pin)(pin)、腌制(zhi)水果和(he)蔬菜、果汁(zhi)、咖(ka)啡及(ji)煙草等(deng)。
(二)各(ge)國(guo)仍(reng)繼續(xu)(xu)(xu)運用(yong)(yong)各(ge)種支(zhi)持(chi)農(nong)(nong)業(ye)(ye)的(de)(de)(de)(de)條款扶持(chi)其(qi)農(nong)(nong)產品(pin)(pin)出口。價格的(de)(de)(de)(de)不(bu)(bu)穩定性是農(nong)(nong)產品(pin)(pin)市(shi)場(chang)(chang)的(de)(de)(de)(de)一個普(pu)遍特征,也是所(suo)有(you)wro成員(yuan)關注的(de)(de)(de)(de)一個政治性、社會性問題。世界各(ge)國(guo)政府都進行干預,避免國(guo)內(nei)市(shi)場(chang)(chang)受(shou)變幻莫測的(de)(de)(de)(de)世界農(nong)(nong)產品(pin)(pin)價格的(de)(de)(de)(de)影響,保(bao)障(zhang)(zhang)農(nong)(nong)民的(de)(de)(de)(de)收(shou)入(ru)水平及國(guo)內(nei)生產的(de)(de)(de)(de)存續(xu)(xu)(xu)。在市(shi)場(chang)(chang)不(bu)(bu)穩定及價格持(chi)續(xu)(xu)(xu)低迷時,美(mei)(mei)國(guo)通(tong)過貸款扶持(chi)計劃(hua)和差價支(zhi)付,歐(ou)盟則通(tong)過共同(tong)農(nong)(nong)業(ye)(ye)政策的(de)(de)(de)(de)不(bu)(bu)同(tong)計劃(hua),經合(he)組織(zhi)成員(yuan)國(guo)通(tong)過多項國(guo)內(nei)支(zhi)持(chi)計劃(hua)來保(bao)障(zhang)(zhang)農(nong)(nong)民的(de)(de)(de)(de)收(shou)入(ru)水平和農(nong)(nong)業(ye)(ye)生產的(de)(de)(de)(de)存續(xu)(xu)(xu)。據經合(he)組織(zhi)(OECD)統計,OECD國(guo)家農(nong)(nong)民收(shou)入(ru)中(zhong)的(de)(de)(de)(de)40%來自政府的(de)(de)(de)(de)補貼(tie),其(qi)中(zhong)日本、挪威、韓國(guo)和瑞士達66%。OECD國(guo)家目前每年對農(nong)(nong)業(ye)(ye)的(de)(de)(de)(de)補貼(tie)總額(e)達3600億(yi)美(mei)(mei)元,其(qi)中(zhong)90%集(ji)中(zhong)在歐(ou)盟、日本和美(mei)(mei)國(guo)。高額(e)補貼(tie)使(shi)發達成員(yuan)的(de)(de)(de)(de)農(nong)(nong)產品(pin)(pin)得以在國(guo)際市(shi)場(chang)(chang)上占有(you)價格優勢(shi)。而(er)我國(guo)在人世承諾中(zhong)提(ti)出不(bu)(bu)使(shi)用(yong)(yong)扭曲貿易的(de)(de)(de)(de)補貼(tie)。

一、引言

二、案例分析

隨著中(zhong)美(mei)農(nong)產品貿(mao)(mao)(mao)易(yi)(yi)的不斷(duan)加強,在(zai)農(nong)產品貿(mao)(mao)(mao)易(yi)(yi)中(zhong)引發的爭端也日益增多。這些爭端嚴重影響了(le)中(zhong)美(mei)農(nong)產品貿(mao)(mao)(mao)易(yi)(yi)的正常(chang)發展。
中(zhong)美(mei)農(nong)產(chan)品(pin)貿(mao)易的(de)摩擦不僅(jin)是(shi)由于極(ji)高(gao)(gao)的(de)關稅征收所導致,更(geng)多的(de)是(shi)來(lai)自那些(xie)隱形的(de)非(fei)關稅壁壘。首先是(shi)對(dui)農(nong)產(chan)品(pin)的(de)高(gao)(gao)額貿(mao)易補(bu)(bu)貼(tie),2002年美(mei)國《農(nong)業法(fa)》修改,使得政府(fu)補(bu)(bu)貼(tie)巨(ju)幅增加(jia)至1900億美(mei)元,范圍包括棉花,大豆,小麥(mai)等大宗(zong)商品(pin)外的(de)其他如花生,羊(yang)毛,蜂蜜等。
其(qi)次是強制(zhi)性技術標準,這里(li)面主要(yao)又(you)包(bao)括(kuo)轉基(ji)因作物(wu)問(wen)題(ti)、綠(lv)色壁(bi)(bi)(bi)壘(lei)與(yu)食品安(an)(an)全(quan)問(wen)題(ti)以及環境壁(bi)(bi)(bi)壘(lei)。2002年我國(guo)(guo)頒布的(de)《農業(ye)轉基(ji)因生物(wu)安(an)(an)全(quan)管理條例(li)》等法(fa)規利用了(le)(le)世貿組織允(yun)許的(de)技術壁(bi)(bi)(bi)壘(lei),限制(zhi)了(le)(le)美(mei)國(guo)(guo)轉基(ji)因作物(wu)的(de)出口,引起了(le)(le)美(mei)國(guo)(guo)的(de)不(bu)滿。同(tong)時(shi)由(you)于中國(guo)(guo)水(shui)果的(de)品質(zhi)差(cha),安(an)(an)全(quan)性低,常(chang)(chang)常(chang)(chang)受到(dao)美(mei)國(guo)(guo)的(de)綠(lv)色壁(bi)(bi)(bi)壘(lei)阻礙(ai),使得(de)中國(guo)(guo)水(shui)果競爭力不(bu)斷減弱。對(dui)于環境壁(bi)(bi)(bi)壘(lei),例(li)如美(mei)國(guo)(guo)對(dui)許多食品的(de)包(bao)裝(zhuang)要(yao)求可降解包(bao)裝(zhuang),盡量減少對(dui)于環境的(de)損害,這也使得(de)貿易(yi)的(de)成本(ben)增(zeng)加,實(shi)現了(le)(le)美(mei)國(guo)(guo)的(de)貿易(yi)保護。
最(zui)后就(jiu)是(shi)關于傾(qing)(qing)銷(xiao)與反傾(qing)(qing)銷(xiao)問題。我國頻頻遭受(shou)農產品(pin)的反傾(qing)(qing)銷(xiao)案件困擾(rao),涉及反傾(qing)(qing)銷(xiao)的商(shang)品(pin)有(you)蜂蜜,大蒜,小龍蝦,濃縮果汁等(deng),被征收高額的反傾(qing)(qing)銷(xiao)稅,使得中國本來具有(you)比較(jiao)優勢的許多商(shang)品(pin)失去了競爭能力(li)。
面(mian)對各(ge)種(zhong)各(ge)樣的貿易(yi)爭(zheng)端,使得我(wo)國(guo)的農產品出口成本上升,國(guo)際競爭(zheng)力下降,我(wo)國(guo)農產品走向美(mei)國(guo)市場受到了阻礙,不(bu)斷引(yin)發的貿易(yi)爭(zheng)端也使得兩國(guo)在農產品領域的貿易(yi)交往受到損害,最(zui)終不(bu)能(neng)最(zui)大化的獲得國(guo)際貿易(yi)的利益。
